1. Introduction

Welcome to Sinaï. These Terms of Service (“Terms”) govern your use of our AI-powered image generation and modification services (the “Services”). By using our Services, you agree to these Terms. If you do not agree, please refrain from using the Services.

2. Eligibility and Age Restrictions

You must be at least 13 years old to use our Services. By accessing the Services, you confirm that you meet this age requirement. Users under the age of majority in their jurisdiction must have a parent or guardian agree to these Terms on their behalf.

3. Service Description

Our app allows users to generate and modify images using AI technology. You can create images for various purposes, including but not limited to logos, book covers, and artwork. The Services are provided “AS IS,” without any warranties regarding quality, stability, or suitability for a particular purpose.

4. Account and Subscription

• Free Use: Users can access basic features of the Services for free, with daily credits provided.
• Premium Subscription: Users may purchase a monthly subscription for additional benefits.
• Credits: Users can purchase credits to generate more images. Credits may also be earned by watching promotional videos.
• No Ads: Except for voluntary promotional videos to earn credits, the app is ad-free for all users.
• Account Requirement: Creating an account and verifying your phone number is required to access AI image generation and editing features. This requirement allows us to effectively enforce limitations on free image generations per user, ensuring the operational sustainability of our infrastructure and preventing abuse from multiple-account creation.

5. Content Ownership and Licensing

• User Content: You retain ownership of any images you generate or modify using our Services. We do not claim any ownership rights over your creations.
• Non-Exclusive License: By using our Services, you grant us a non-exclusive, royalty-free license to use, reproduce, and display your content solely for the purpose of providing and improving the Services.

6. Community Guidelines

• Respectful Interaction: Users are encouraged to respect each other, share knowledge, and foster creativity within the community.
• Prohibited Content: Users may not create or share content that is sexually explicit, involves nudity, racist, harasses others, spreads fake news, or is intended to harm others. Modifying images of individuals without their consent is strictly prohibited.
• Additional Prohibitions: You may not use, or facilitate or allow others to use, the Services to:
  • Intentional Disinformation or Deception: Generate or modify images to intentionally spread false or misleading information.
  • Privacy Violations: Violate the privacy rights of others, including unlawful tracking, monitoring, or identification through generated content.
  • Unauthorized Use of Personal Likeness: Depict a person’s voice, image, or likeness without proper consent, including unauthorized impersonation and non-consensual sexual imagery.
  • Harm or Exploitation of Minors: Create or distribute content that exploits, harms, or endangers minors, including grooming or child sexual abuse material.
  • Harassment and Targeted Harm: Harass, threaten, or harm individuals or groups based on race, religion, gender, sexual orientation, disability, or other attributes.
  • Circumvention of Safety Features: Intentionally bypass safety filters, security features, or functionality designed to prevent misuse of the Services.
  • Harmful or Lethal Applications: Use the Services to create, modify, or enable functionality intended for lethal purposes, including automated weapons, without human oversight or control.
• Enforcement: Violation of these guidelines may result in a permanent ban from the Services without refund.

7.1 Account Deletion and Data Loss

If you choose to delete your account, all personal data associated with your account will be permanently erased from our systems. Additionally, any paid credits, subscriptions, or other benefits linked to your account will be forfeited and cannot be recovered. By deleting your account, you acknowledge and agree that this action is irreversible and that Sinaï holds no responsibility for any loss of data, credits, or subscriptions resulting from the deletion of your account.

7.2 Right to Suspend or Terminate Access

We reserve the right to suspend or terminate your access to the Services at any time, if you violate our Terms or the Community Guidelines. In such cases, no refund will be provided. Additionally, we may take any further actions deemed necessary, including the removal of content, restriction of account features, or pursuing legal remedies, to enforce compliance with our Terms.

7.3 Service Availability, Discontinuation, and Refund Policy

7.3.1 Right to Modify or Discontinue the Services:
We reserve the right to modify, suspend, or discontinue the Services (or any part thereof) at any time, with or without notice. We shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Services.

7.3.2 No Guarantee of Continuous Service:
By purchasing a subscription or credits, you acknowledge that we do not guarantee uninterrupted or continuous availability of the Services. You accept that our Services may be subject to changes in functionality or discontinued altogether at our sole discretion.

7.3.3 No Refunds Upon Discontinuation:
In the event that we cease operations, discontinue the Services, or otherwise limit your ability to use purchased credits or subscriptions, you agree that you are not entitled to a refund (partial or whole) of any credits or subscription fees. All unused or remaining credits will be forfeited, and no compensation shall be provided.

8. Dispute Resolution

Any disputes arising from these Terms or your use of the Services will be governed by the laws of Israel. Disputes will be resolved through arbitration in Israel, following the rules of the Israel Arbitration Association. Both parties will bear their own legal fees.

9. Limitation of Liability

Our Services are provided “AS IS” without any guarantees. To the fullest extent permitted by law, we are not liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including loss of profits or data, arising from or relating to your use of the Services.

10. Changes to the Terms

We may update these Terms from time to time. Continued use of the Services constitutes acceptance of the updated Terms. It is your responsibility to review the Terms periodically.
